Mayor Alfred: "Do not panic!"

In Tacloban City, Mayor Alfred Romualdez on Thursday said there was no need to declare the city under a state of calamity even as it was on a “full campaign” to combat the spread of the flu virus.

He said in a press conference that the city has a population of 280,000 and the number of positive flu cases reported in Tacloban as of Thursday afternoon was just 62.

He also called on city residents not to panic.

“Expect the number to grow because Tacloban City is a transient city with a population that practically doubles during the day and the population during the weekend is different from the weekdays,” the mayor said.

He said while many new cases emerge daily, many cases have recovered.

Dr. Jaime Opinion, Tagbilaran City health officer, said 15 schools in his city have suspended classes because of the flu.

Seven other schools, he said, are to suspend classes because of “clustering” of cases.

“When we say clustering, one class has 40 to 50 percent of the students already having influenza-like illness [such as] 37.8°C fever, sore throat, appetite loss, muscle pains, vomiting or loose bowel movement,” Opinion said.

Mayor Romualdez also said in the press conference that his daughter, who was positive with A(H1N1), was now recovering.

“She’s recovered quite fully,” the mayor said.

Barbecue stall holders occupying Balyuan lot fear of losing their livelihood

TACLOBAN CITY - Barbecue stall holders occupying the half wing of the Balyuan lot near the amphitheater are now in quandary where to go to continue their livelihood once the area is taken back by the province of Leyte anytime this month, as the provincial government had been claiming lately that the area is their property.

But the city government is unfazed of the announcement being made by the provincial government and perceived to only create confusion and panic among the people of Tacloban. Thus, the barbecue stall holders should not stay and not be worried.

Land ownership

This week, in an interview with Mayor Alfred Romualdez, he said, there is no land title showing that the lot belongs to the provincial government "therefore their claim has no basis at all."

In an interview by ABS-CBN Tacloban this week Mayor Romualdez said, the provincial government has only a tax declaration, "pero bakit ang titulo nila ay issued by the US government. As such, a US government issued title is automatically transferred to the national government- and for the national government to transfer the land ownership to the local government unit it would need a Presidential Declaration."

The city mayor said the city government will challenge the tax declaration of the provincial government claiming over Balyuan, saying that what they are showing now to the courts is a spanish title.

He said there are two Republic Acts and one Presidential Declaration that cancels Spanish titles. "Now, is there a presidential declaration saying that they own the property?- Alamin natin ang batas. eh ang nangyayari laging haka-haka," he said.

This battle over the Balyuan property will still go up to the high courts which is the proper body to determine as to who has the right over the property, said Romualdez.

As it is now, even at the height of the talks that the land is in the possession of the provincial government, the city government did not stop developing the area. The place that is occupied nightly by barbecue stalls is now fully asphalted giving more convenience to the vendors and customers at night-and to joggers at day time.

The other wing (near DYVL) ground is at least 90 percent cemented as the development works is on going- this is also where the new Balyuan Convention Center (BCC) stands catering to government and private agencies activities.

Spanish Title can no longer be used as evidence of land ownership.

"WHEREAS: The Spanish Title-01-4, Titulo de Propiedad-4136 are already nullified and no longer admissible as evidence of ownership, with this passage of Spanish Mortgage Law of Presidential Decree No. 892, effective February 16, 1976, Spanish Title can no longer be used as evidence of land ownership. Under the same decree, lands not under the Torrens System shall be considered as unregistered land. (Republic vs. Court of Appeals, 135 SCRA 156; Director of Lands vs. Rivas, 141 SCRA 329) (Republic vs. Intermediate Appellate Court, 186 SCRA 88) `LET THE PEOPLE KNOW' Book

On the other hand, when the Americans paid the Spanish Government $20 Million just after the Spanish-American War for Spanish titles and Spanish Friar lands, when the William H. Taft administration issued Original Certificates of Titles, and when Ferdinand Marcos issued the Property Registration Decree covering such things as land patent applications for alienable and disposal lands, the issue on Spanish titles had become moot and academic a very long time ago.

Section 3. of P.D. 1529 states or the Status of other pre-existing land registration system states that; The system of registration under the Spanish Mortgage Law is hereby discontinued and all lands recorded under said system which are not yet covered by Torrens title shall be considered as unregistered lands.

Hereafter, all instruments affecting lands originally registered under the Spanish Mortgage Law may be recorded under Section 113 of this Decree, until the land shall have been brought under the operation of the Torrens system.

The books of registration for unregistered lands provided under Section 194 of the Revised Administrative Code, as amended by Act No. 3344, shall continue to remain in force; provided, that all instruments dealing with unregistered lands shall henceforth be registered under Section 113 of this Decree.

PRESIDENTIAL DECREE No. 1529 otherwise known as the "AMENDING AND CODIFYING THE LAWS RELATIVE TO REGISTRATION OF PROPERTY AND FOR OTHER PURPOSES was signed into law by then President Ferdinand E. Marcos on June 11, 1978.

City administrator reacts on Balyuan property issue

TACLOBAN CITY - The demand letter issued by the provincial government against the city government over the Balyu-an property was loaded with "official protocol violations" and "legal flaws."

Thus said City Administrator Robert Muñoz in reaction to an earlier communication issued by his counterpart, Provincial Administrator Vincent Emnas, asking the city government to "immediately vacate" the 6,941 square meters property located along Magsaysay Boulevard, this city.

The area houses a building where the offices of health, social welfare and assessor, among others, are located. Councilor Cristina Gonzalez-Romualdez, wife of Mayor Alfred Romualdez, also holds office in the same building.

The multi-million Balyu-an amphitheater is also located in the same contested area together with a convention area-cum-training center.

Muñoz, in his letter, said that instead of addressing his letter to the city mayor, Emnas should have addressed his October 19 letter to his office, being his counterpart.

"As to the official protocol violations, you are not of the same level as the honorable city mayor of Tacloban, a highly urbanized city. Your letter therefore is not only uncalled for, it also constitutes official disrespect and discourtesy," the city administrator, on his two-page letter, said.

And as to legal flaws, the contested property remains under court litigation which made Emnas' move as "highly contumacious" which could be ground for indirect contempt.

"It contains allegations that tend to degrade, impede or obstruct the administration of justice or pre-empt (the court) of whatever decision it will make on the said case..." Muñoz said in his letter.

The city and provincial governments are in legal battle over the said property, largely known as Balyu-an property, over ownership of the 6,941 square meter property. The case, lodged before Judge Salvador Apurillo of Regional Trial Court Branch 8, was also referred for a possible mediation.

Emnas, in his one-page October 19-dated letter addressed to City Mayor Alfred Romualdez, asked the city government "to immediately vacate the said lots and to pay a reasonable value of rental for the use or occupation thereof...."

City Legal Officer Sergio Sumayod, meantime, maintains that the province has no right to claim the property considering that it has no documents to prove that it owns the property other than a tax declaration.

"While the city government has no documents to prove its ownership just like the province, we have been in possession of the property for the longest time already," Sumayod said.

It is the national government, he said, that owns the property.

Leyte Governor Carlos Jericho Petilla said that he is leaving the matter to his legal team to resolve the issue. "I don't like to be preoccupied with that issue. The provincial legal office will handle that," he said in a separate interview.

He, however, maintains that the province owns the property and that the city government should honor an earlier agreement it entered with the province.

The governor was referring to the August 26, 2004 memorandum of agreement signed by then city mayor, Alfredo "Bejo" Romualdez, the father of the incumbent mayor, for the city to use the property.

"We were deceived by the province that it owns the property. That is why the former mayor, acting on good faith, entered an agreement," Sumayod said.

Last July 10 of this year, the city government filed a case before the court seeking for the annulment of the agreement that expired last August 26 or five years after it was signed.
